US businessman files suit against Atkins diet program

WASHINGTON (AFP) - A Florida businessman has filed suit against Atkins
Nutritionals, charging that the company's high-protein, low-carbohydrate
diet regimen caused his severe heart disease, which nearly killed him.

Jody Gorran filed the lawsuit against Atkins Nutritionals and the estate of
the late doctor Robert Atkins in a Palm Beach County, Florida court after
undergoing heart surgery that he claims was necessary to save his life from
the bad effects of the diet.

"I'm suing the Atkins empire because I want the public to know that the
Atkins diet may be killing people. I believe that the diet almost killed
me, by giving me heart disease," Gorran told reporters in Washington.

The Delray Beach, Florida businessman is seeking 15,000 dollars in
compensation, which he says will be given to charity, and is demanding that
health warnings be placed on all Atkins products.

Six months before starting the program, Gorran, now 53, underwent a heart
test which found him to be in excellent health, with no trace of plaque or
occlusion, according to cardiologist David Nash, head of the Syracuse
Preventive Cardiology Center in New York State.

Gorran followed the diet for two and a half years before being stricken
with angina. Tests revealed that one of his coronary arteries was 99
percent blocked.

He underwent surgery to open the blocked artery, and a stent was inserted
to keep the artery open. He stopped following the diet on the advice of his
doctors, and claims his unhealthy cholesterol levels dropped immediately.

Gorran is receiving legal counsel from the Physicians Committee for
Responsible Medicine (PCRM), a pro-vegetarian group, which raised the ire
of Atkins representatives.

Gina Mangiaracina, an Atkins spokeswoman, charged that the lawsuit "is just
for publicity.

"We should not let the real issue, providing people with a scientifically
validated nutritional choice in the face of a worldwide obesity and Type 2
diabetes epidemic, be manipulated by this extremist animal rights vegan
group," she said, referring to PCRM.
The Atkins program advocates a diet high in protein at the expense of
carbohydrates.

According to Atkins's theories, eating virtually no carbohydrates causes
the body to enter a state known as ketosis, in which it uses stored body
fat as fuel.

The unique selling point is that if dieters stick to certain types of
foods, principally meat, fish, eggs and dairy products, they can
theoretically eat as much as they want and yet still shed weight.

the vegans sought him out to push their political agenda.

No, it's pretty clear this guy did do his homework,
by studying Atkins' literature and seeing the enormous
flaw in the diet. This suit may be predatory, but it's
not frivolous.

And the astroturfing from the Atkins corporate hydra has
been thick enough that I'm willing to bet they're scared
****less about it.

If so, he hadn't the wit to act on those insights until after he had adopted
the diet and advocated it publicly. Perhaps he can include himself as a
defendant, if he can prove that he led himself astray. Even if he doesn't,
perhaps the copycat suits will.

I would do it the way he did. Assume the position of one who
believes what the program tells him to. And then assume the
position of one made indignant through betrayal.

beginning ANY diet regimen??? More importantly, most of these
so-called diets are okay in the short run (a great way to get
started), but have their problems in the long run.

As a long time runner and marathoner and now marathon walker, most of
us feel Jim Fixx would have died much earlier if he hadn't exercised
at all. I read his book (beautiful legs on the cover jacket) decades
ago and vaguely remember that his father died much earlier than Jim
did. I think he would have hated people to remember he died in his
50's (I think) and that all his aerobic efforts were for not. Just my
$.02.

I for one am not at all surprised. This is not uncommon - even journalists
who are writing about the diet often have the facts wrong. The most common
misconception is that while on Atkins you can eat an unlimited amount of
saturated fats. This is simply false but many people believe it.

The only reason I'll support Atkins is because soon I'll *have* to go on
a modified Atkins diet (espeically made for renal/diabetic patients).

Plus, not all diets work for everyone. Christ, if everyone sued every
diet plan because it didn't work..well, talk about crowded courtrooms.

I just think ppl have become too sue-happy over stuff nowdays. We'll see
how this goes.

Thanks for bringing that up! Perfect example of someone doing "all the
right things" and he STILL died from heart failure.

It may be interesting to note that the plaintiff is supported by a group
supported by PETA which is always opposing meat eating. I think it's pretty
political. Good cooking.
